Biography

Jessica Lee is a partner in the Firm’s Litigation & Arbitration Practice Group.

Jess acts for both corporate and individual claimants and defendants in complex and high value commercial litigation with particular experience in civil fraud and asset recovery actions, company and shareholder disputes, and crypto and blockchain matters. Jess is recognized as a Next Generation Partner for civil fraud in The Legal 500 having acted on a number of significant civil fraud matters, many of which have also involved advising on freezing, proprietary and disclosure injunctions. Jess is also part of Brown Rudnick’s Supervising Solicitors team and having acted on obtaining and executing multiple search, delivery up and imaging orders. Jess also acts on a range of commercial disputes, including company and shareholder disputes and unfair prejudice petitions, and crypto and blockchain matters. Her practice in the crypto space includes cryptoasset fraud and recovery actions, shareholder disputes, litigation arising from large crypto exchange insolvencies and claims arising from decentralised finance protocols, as well as advising on risk management, compliance and regulatory issues. Jess is regularly invited to speak and write on issues, including crypto fraud and blockchain disputes and regulation and contributed to the U.K. Jurisdictional Taskforce Legal Statement on Digital Securities.

Jess has also advised on significant investigations and compliance matters including investigations by the U.S. Department of Justice and the Serious Fraud Office. 

In The Legal 500, Jess is described as having “a keen eye for detail, superb litigation knowledge and experience, and always the brightest attitude and mode of communication.” She was also described as “particularly strong in the tech and cyber sectors” and forging a reputation in digital assets disputes.” She is also a recommended lawyer in The Legal 500 in the categories of Commercial Litigation: Premium and Banking Litigation: Investment & Retail. Jess was also named as a future leader in commercial litigation by Who’s Who Legal in 2022.

Jess is a keen advocate for diversity and social mobility; she is part of the leadership team for the Firm’s Women’s Initiative and has mentored younger lawyers and law students, including on the IntoUniversity programme.

Prior to joining Brown Rudnick, Jess was an associate at Baker & McKenzie where she also trained. Jess has undertaken a number of client secondments including a major international telecoms provider and a leading global financial institution.

Litigation & Arbitration

Acting for a HNWI crypto investor in claims concerning a Decentralised Finance platform

Advising a prominent NFT artist in claims for breach of contract against a commercial counterparty.

Advising on litigation and subsequent settlement for BlockFi plan administrator Mohsin Meghji and the unsecured creditors of the collapsed cryptocurrency giant with the estates of FTX and its affiliate, Alameda Research, for nearly $1 billion.

Quay House Admirals Way Land Ltd and another v Rockwell Properties Ltd [2022] EWHC 545 (Ch)

Representing numerous Defendants in a £1.5 billion fraud claim brought by the Danish tax authority and advising on freezing and proprietary injunctions obtained in connection with the dispute. Mr. Justice Andrew Baker described this case as “litigation on a massive scale,” with almost 100 defendants listed alongside more than 20 separate legal teams. The Lawyer’s listing of the Top 20 high-profile cases in 2021 includes Jessica’s representation in this case.

Acting for a Defendant in a fraud claim in excess of US $800 million brought by the Kuwaiti state pension fund. The claim concerns allegations of fraud, bribery and corruption spanning three decades. The case was included in The Lawyer’s list of the top 20 cases for 2020.

Acting for a group of more than 100 Claimants in a securities claim relating to misleading published information  brought under section 90A FSMA.

Acting for a digital platform in seeking the recovery of misappropriated cryptocurrency.

Acting for both founders and shareholders in a wide range of shareholder and company disputes.

Advising senior management in relation to a dispute concerning fraudulent misrepresentation claims.

Acting in a breach of confidence and privacy claim arising out of covert recordings of the Claimants and, during the pandemic in 2020, obtaining and executing: doorstep delivery-up injunctions requiring the defendants to immediately hand up specified items and answer questions on oath; super injunctions; gagging orders; and forensic imaging of electronic devices orders. The case was reported:

Jessica was part of the Supervising Solicitor’s team in relation to a search, seizure and forensic imaging order in the reported case of Akhmedova V Akhmedov & Ors [2020] EWHC 3006 (Fam).
