Biography

David Weinstein is an associate in the Firm's Litigation & Arbitration Practice Group. David serves as counsel in complex commercial litigation matters and international arbitration proceedings.

David has experience in disputes relating to assets of foreign entities, cryptocurrency, energy, telecommunications, media, infrastructure, construction, joint ventures, and shareholder agreements. He commonly deals with disputes involving parties in Latin America, the Middle East and Africa. He also has experience with compliance matters dealing with corporate practices, anti-corruption and economic sanctions. He is increasingly involved in restructuring litigation arising from major Chapter 11 and Chapter 15 proceedings.

David is a member of the UNCITRAL Working Group II on Dispute Settlement, regularly contributing to developments in the UNCITRAL Arbitration Rules. He acts as an arbitrator for the FDI International Arbitration Moot Competition and is a member of the Arbitration Committee of the New York City Bar Association. He currently serves as Secretary to the Global Steering Committee of the Campaign for Greener Arbitrations, and has acted as a consultant to the Organisation for Economic Co-operation and Development.

Representation

Represented the wind-down debtors of BlockFi, a multibillion-dollar cryptocurrency platform, lender and “crypto bank,” in restructuring litigation against FTX and Three Arrows Capital.

Represented a Swiss fintech company in a New-York based dispute against its former CEO and founder on the grounds of a non-competition agreement.

Represented BVI Liquidator of the Fairfield Funds (the largest feeder funds into the Madoff Ponzi scheme) in the Funds’ Chapter 15 case in the U.S. District Court for the Southern District of New York.

Represented the Official Committee of Talc Claimants in the Chapter 11 proceedings of Johnson & Johnson’s talc liability special purpose vehicle, achieving dismissal of an $8.9 billion plan based on lack of good faith/financial distress.

Represented victims of sex trafficking against several major online content streaming companies and Visa before the U.S. District Court for the Central District of California.

Represented the Government of Kuwait in U.S. civil forfeiture and civil fraud proceedings.

Counsel to German and Brazilian subsidiaries of a French water management group against Swiss and Brazilian subsidiaries of an American energy group in connection with the construction of a water treatment plant in Brazil (ICC arbitration).

Counsel to a Caribbean energy exploration company in several disputes against a North African state regarding the expropriation of the company’s share of production in an offshore concession and the withdrawal of offshore exploration permits (ICC Arbitration).

Represented a Luxembourg telecommunications company in a post-M&A dispute with a company in central Europe (ICC arbitration, English law).

Advised an international automotive group in various pre-litigation and pre-arbitration international disputes relating to distribution agreements, agent contracts, and product liability.

Represented a European joint venture against several of its shareholders and directors in the energy industry in relation to the violation of long-term commitments and fiduciary duties (ICC arbitration, Paris seat, French law).

Counsel to a French energy provider in relation to the termination of long-term commercial agreement (three ICC arbitrations, Paris seat, French law).

Counsel to a Canadian forestry company in a U.S. federal defamation suit.

Counsel to a Saudi investor in an arbitration relating to the performance of a partnership agreement over the management of a public cement plant in Algeria (Algerian law).
